Daily Monitoring of the Tariff Quota Usage for the Ukrainian Steel Products import to EU: II Period (1.07.2019-30.06.2020)

According to EC Regulation 2019/1590 of 26 September 2019, safeguard measures cover 12 categories of Ukrainian steel products of which 11 are under the country-specific quotas (on the yearly basis), and category 20 (Gas Pipes) is under the global tariff quota (with quarterly breakdown). Where the relevant tariff-rate quota is exhausted an additional duty at the rate of 25 % shall be applied on these product categories.

Individual tariff quota for category 19 (Railway Material) for Ukraine was valid until 30 September 2019. Since 1 October 2019, the unused quota volume of this category was added to the global tariff quota.

Where the relevant quota is exhausted for one specific country, imports from that country can be made under the remaining part of the tariff-rate quota for the same product category without any 25% duty. That provision shall only apply during the last quarter of each year of application (i.e. II, VI and X quarters) of the definitive tariff-rate quota. For categories 13 and 16, after as the country will use individual tariff quotas completely, it is allowed for this country to use no more than 30% of the remain global tariff quotas of these categories.

Category 1 (Non Alloy and Other Alloy Hot Rolled Sheets and Strips) remains as the global tariff quota for all countries, but no single exporting country should be allowed to exceed a share of 30 % of the global TRQ available per quarter during the remaining duration of the measures.

The 5% quota volumes increase for each next period had been replaced with 3% increase.

Peculiarities of the global tariff quota:

  • at the end of each quarter but within the same period only, the unused balances of the tariff-rate quota shall automatically be transferred to the next quarter;
  • the unused balances of the tariff-rate quota of the last quarter of the current period, if they are not awaiting allocation, are not transferred to the next period;
  • the drawings on each quarterly quota shall be stopped on the twentieth working day of the Commission following the end of the quarterly period to allow to use all awaiting allocation volumes that formed before the end of the previous quarter;
  • if the quarter quota is exhausted before the end of the current quarter, the 25% duty is being implemented till the beginning of the next quarter.

Peculiarities of the individual (country-specific) quota:

  • the unused balances of the tariff-rate quota of the current period, if they are not awaiting allocation, are not transferred to the next period;
  • in case if the individual quota is exhausted before the end of the current period and when there is lack of remaining volumes of the relevant global tariff quota, the 25% duty is being implemented till the beginning of the next period.
